The Motion of Facebook, Inc. to dismiss the Plaintiff's second amended complaint came on for hearing on August 5, 2010, before the Honorable William H. Alsup; The Court, having considered the papers filed in support of and in opposition to the motions, the arguments presented at the hearing and other matters relevant to the determination of these motions Hereby finds and ORDERS 1. Complaint is dismissed in its entirety as to Defendant Facebook; 2. Plaintiff Miller is to file an amended complaint removing Facebook from the caption.
