Having carefully considered the papers, evidence, and oral arguments presented by the parties, Plaintiffs' Motion is GRANTED and the Court orders as follows: 1. Plaintiffs' Motion to compel discovery from Defendant SCEA that is in the possession, custody and control of Sony Computer Entertainment, Inc., ("SCEI") is hereby granted. The Court finds that in light of (a) SCEA's ability to produce responsive documents in 1 [PROPOSED] ORDER GRANTING PLAINTIFFS' MOTION TO COMPEL CASE NO. CV-10-01811-RS Dockets.Justia.com 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SCEI's possession, custody and control, as well as (b) the marketing and agency relationship between SCEA and SCEI, that documents within SCEA's possession, custody and control, and responsive to Plaintiffs' Requests for Production of Documents are sufficiently deemed in the possession, custody and control of SCEA and therefore shall be produced in this litigation. 2. Plaintiffs' Motion for entry of the Northern District of California's Stipulated Protective Order for Standard Litigation is hereby granted. Plaintiffs shall submit the Stipulated Protective Order for Standard Litigation for this Court's signature within five business days. Defendant shall produce any "confidential" documents it has been withholding that are responsive to Plaintiffs' First Set of Requests for Production of Documents within 10 business days.
