The Court finds that AT&T Mobility LLC (“ATTM”) is a necessary party to this action,

and that joinder of ATTM is possible and therefore required under Fed. R. Civ. Proc. 19(a). The

Court further finds that ATTM is an indispensable party under Fed. R. Civ. Proc. 19(b), such that

4

in equity and good conscience this case may not proceed in its absence.

The Court thus GRANTS Defendant Apple Inc.’s Motion to Dismiss for failure to join an
indispensable party under Fed. R. Civ. Proc. 12(b)(7).
