Plaintiff has failed to file a second amended complaint by the deadline. Accordingly,

this action is DISMISSED without prejudice for failure to comply with the Court’s order and,
20
pursuant to Federal Rule of Civil Procedure 41(b), for failure to prosecute. Plaintiff’s motion
21
to extend time (Docket No. 6) is DENIED. Any motion to reopen this action must contain an
22
amended complaint. The Clerk shall terminate Docket No. 6, enter judgment in favor of
23
defendants, and close the file.
