JOHN DOE, Defendant. / 15 16 The Court ordered plaintiff to, within 30 days, (1) submit payment for the $350.00 17 filing fee, or (2) an application to proceed in forma pauperis (“IFP”). More than 30 days 18 have passed and plaintiff has not complied with any of these instructions. Accordingly, the 19 action is DISMISSED without prejudice for failure to comply with the Court’s order and, 20 under Federal Rule of Civil Procedure 41(b), for failure to prosecute. Any motion to reopen 21 must contain either full payment of the filing fee of $350.00, or a complete IFP application. 22 The Clerk shall enter judgment in favor of defendant, and close the file. 23 24 25 IT IS SO ORDERED.
