R. Civ. P. 41(b). Because this dismissal 20 is without prejudice, plaintiff may move to reopen the action. Any such motion must contain 21 an amended complaint that addresses the deficiencies discussed in the order dismissing the 22 complaint with leave to amend. Plaintiff’s motion to extend time (Docket No. 4) is 23 DENIED. The Clerk shall terminate Docket No. 4, enter judgment in favor of defendants, 24 and close the file. 25 26 27 IT IS SO ORDERED.
