No. C 14-2302 LB
ORDER OF TRANSFER
[Re: ECF No. 1]
v.
13
TIM VIRGA,
14
Defendant.
_____________________________________/
15
16
Plaintiff, an inmate at the California Men's Colony in San Luis Obispo, filed this pro se civil
17
action, complaining of events and omissions that occurred at the California State Prison -
18
Sacramento. The prison is located in Sacramento County, within the venue of the Eastern District
19
of California. The named defendant works at that prison and apparently resides within the venue of
20
the Eastern District of California. No defendant is alleged to reside in, and none of the events or
21
omissions giving rise to the complaint occurred in, the Northern District of California. Venue
22
therefore would be proper in the Eastern District, and not in this one. See 28 U.S.C. § 1391(b).
23
Accordingly, in the interest of justice and pursuant to 28 U.S.C. § 1406(a), this action is
24
TRANSFERRED to the United States District Court for the Eastern District of California. The clerk
25
shall transfer this matter.
26
27
IT IS SO ORDERED.
Dated: June 12, 2014
