United States District Court Northern District of California 11 12 13 Plaintiff has filed a pro se civil rights action pursuant to 42 U.S.C. § 1983 describing 14 events leading to his criminal conviction in Madera County, California. Madera County is located 15 within the venue of the Eastern District of California. See 28 U.S.C. § 84(b). No defendant is 16 alleged to reside in, and none of the events or omissions giving rise to the complaint occurred in, 17 the Northern District. Venue therefore is proper in the Eastern District, and not in this one. See 18 28 U.S.C. § 1391(b). 19 Accordingly, in the interests of justice and pursuant to 28 U.S.C. § 1406(a), this action is 20 TRANSFERRED to the United States District Court for the Eastern District of California. The 21 Clerk of the Court is directed to transfer the case forthwith. In view of the transfer, the Court will 22 not rule upon plaintiff’s request for leave to proceed in forma pauperis or motion for appointment 23 of counsel. 24 25 26 27 28 IT IS SO ORDERED.
