Pursuant to Civil Local Rules 7-11 and 79-5, the National Collegiate Athletic Association
2 (“NCAA”) respectfully submits this Administrative Motion to File Under Seal Confidential
3 Materials. In particular, the NCAA moves to file under seal its Memorandum in Response to
4 Plaintiffs’ Form of Proposed Injunction.

In determining whether compelling reasons exist to seal, the court shall consider the
6 “‘[1] public interest in understanding the judicial process and [2] whether disclosure of the
7 material could result in improper use of the material for scandalous or libelous purposes or
8 infringement upon trade secrets.’” Hagestad v. Tragesser, 49 F.3d 1430, 1434 (9th Cir. 1995)
9 (quoting EEOC v. Erection Co., 900 F.2d 168, 170 (9th Cir. 1990)).

Specifically, NCAA’s Memorandum in Response to Plaintiffs’ Form of Proposed
11 Injunction contains confidential information filed under seal at the direction of the Court, pursuant
12 to discussion at sidebar on June 26, 2014.
