ORDER DISMISSING
CASE FOR FAILURE
TO PROSECUTE
Plaintiffs,
6
7
No. C 10-4785 CW
v.
US BANK NATIONAL ASSOCIATION,
Defendant.
________________________________/
11
On August 22, 2010, pro se Plaintiffs Jose M. Bernardo and
12
Araceli B. Bernardo filed this foreclosure-related action against
13
Defendant U.S. Bank National Association.
14
On August 22, 2011, the Court issued an order granting
15
Defendant’s motion to dismiss and denied as moot Plaintiffs’
16
motion for a preliminary injunction.
At that time, the Court
17
granted Plaintiffs leave to amend to cure the deficiencies in
18
their original complaint within fourteen days and warned that
19
failure to file an amended complaint would result in dismissal of
20
their action for failure to prosecute.
Plaintiffs have not filed
21
an amended complaint.
22
On August 31, 2011, the United State Postal Service returned
23
the order as undeliverable to Plaintiff Jose M. Bernardo.
On
24
September 26, 2011, the United State Postal Service returned the
25
order as undeliverable to Plaintiff Araceli B. Bernardo.
26
Because Plaintiffs have failed to file an amended complaint
27
as required by the August 22, 2011 order and have failed to update
28
1
their current address or addresses, Plaintiffs’ complaint is
2
dismissed for failure to prosecute.
3
IT IS SO ORDERED.
