The Court, having considered Defendant’s Motion To Stay Based On Recently Filed FCC

Petition (the “Motion”), as well as all other matters properly before the Court, hereby orders as
3
follows:

The Motion is GRANTED. The Court finds that presently before the Federal
5
Communications Commission (“FCC”) is a petition filed by GroupMe, Inc. (“GroupMe
6
Petition”) requesting that the FCC, pursuant to its Congressionally-vested authority to adopt
7
regulations implementing the requirements of the Telephone Consumer Protection Act, decide
8
two issues central to this action. Accordingly, the Court orders that this action is STAYED
9
pending resolution by the FCC of the GroupMe Petition
10
IT IS SO ORDERED.
