EZRA TIMOTHY HOYT and HEATHER HOYT COOPER, Defendants. ________________________________/ 17 On November 23, 2011, Defendant Ezra Timothy Hoyt submitted a 18 letter to the Court stating his desire to relinquish his claim to 19 the $58,000 life insurance benefit that is at issue in this case. 20 Mr. Hoyt's letter, as well as Plaintiff's November 1, 2011 case 21 management statement, indicate that Mr. Hoyt is currently residing 22 in Napa State Hospital. Plaintiff has also informed the Court 23 that Mr. Hoyt has been appointed a conservator in a Sonoma County 24 Superior Court proceeding, SPR-82694, and an attorney in the 25 criminal case against him, SCR-509891, also brought in Sonoma 26 County. 27 28 1 Within thirty days from the date of this order, the 2 conservator, Mr. Hoyt's attorney, Napa State Hospital legal staff 3 and Plaintiff may submit letters to the Court explaining their 4 position as to Mr. Hoyt's waiver of his claim to the insurance 5 benefit. 6 within thirty days from the date of this order. 7 mail a copy of this order and Mr. Hoyt's letter to Mr. Hoyt's 8 court-appointed conservator, his court-appointed counsel, the Napa 9 State Hospital legal staff and Ms. Cooper.
