Plaintiff was warned that failure to file a second amended 17 complaint would result in dismissal of this action for failure to prosecute. Plaintiff did not file a 18 second amended complaint. 19 Accordingly, pursuant to Federal Rule of Civil Procedure 41, this action is DISMISSED 20 WITHOUT PREJUDICE for failure to prosecute. 21 IT IS SO ORDERED.
