Plaintiff has filed a 17 motion indicating that due to medical problems, he is unable to currently file an amended 18 complaint. 19 Plaintiff’s motion (Docket No. 17) is GRANTED in that this action will be DISMISSED 20 without prejudice and plaintiff may seek to reopen this case at a future date if he files an 21 amended complaint. 22 23 IT IS SO ORDERED.
