This is a civil rights case filed pro se by a prisoner at Salinas Valley State Prison.

Plaintiff’s complaint was dismissed with leave to amend and the court has granted plaintiff
16
several extensions, but he has still failed to file an amended complaint. Plaintiff has filed a
17
motion indicating that due to medical problems, he is unable to currently file an amended
18
complaint.

Plaintiff’s motion (Docket No. 17) is GRANTED in that this action will be DISMISSED
20
without prejudice and plaintiff may seek to reopen this case at a future date if he files an
21
amended complaint.
