This is a civil rights case filed pro se by a state prisoner. In the initial review order the

14 court concluded that plaintiff had failed to state a claim and dismissed the complaint with
15 leave to amend. Although the time to amend has expired, petitioner has not amended. This
16 case is DISMISSED with prejudice and plaintiff’s motion to appoint counsel (Docket No. 3) is
17 DENIED.
