On July 19, 2017, the Court rescheduled the case management conference noticed for July

25, 2017 to October 3, 2017. (Dkt. No. 9.) On July 25, 2017, Plaintiff filed a request to have the

15

case management conference held on either August 2, 2017 or August 11, 2017 on the grounds

16

that continuing the hearing to October is unnecessary delay. (Dkt. No. 16.) As an initial matter,

17

the undersigned holds case management conferences on Tuesdays and neither proposed date is a

18

Tuesday. Moreover, the case management conference was rescheduled, in part, because the

19

defendants have not appeared, and the Court has the discretion to control its calendar.

Accordingly, Plaintiff’s request to advance the case management conference to a date in
August is DENIED.
IT IS SO ORDERED.
