The Court has received Elan Microelectronics Corporation’s (“Elan’s”) Motion to Compel
Discovery on Various Issues. Good cause appearing, the motion is GRANTED.

Apple is hereby ORDERED to produce, within 10 days:

1. Sales, profit, cost information, in native spreadsheet format, for iPod and MacBook

products without the Multi-Touch feature since 2003;
2. All communications with third parties concerning Apple patents-in-suit, Elan, Elan
products, the issued subpoenas or any aspect of this lawsuit pursuant to RFP 29;
3. All documents responsive to RFPs 101-104 relating to the accused functionality of the
accused products.
