Plaintiff and Counterclaim Defendant Elan Microelectronics Corp. (“Elan”) and

Defendant and Counterclaim Plaintiff Apple Inc. (“Apple”), by and through their undersigned

counsel, hereby advise the Court that they have settled their dispute that gave rise to their

4

respective claims for relief sought in this lawsuit. The parties respectfully request that the claims

5

for relief asserted against Apple by Elan herein be dismissed with prejudice, and all counterclaims

6

for relief against Elan by Apple be dismissed with prejudice and that the Court enter an order that

7

all attorneys’ fees, costs of court and expenses shall be borne by each party incurring the same. A

8

proposed order is submitted herewith.
