On October 22, 2012, Plaintiff, proceeding pro se, filed a civil rights action pursuant to

18

42 U.S.C. § 1983. On January 11, 2013, the Court screened Plaintiff’s complaint, and dismissed

19

it with leave to amend. The Court directed Plaintiff to file an amended complaint within thirty

20

days. Plaintiff was cautioned that his failure to file an amended complaint within thirty days

21

would result in the dismissal of this action. To date, Plaintiff has not filed an amended

22

complaint.

Thus, the instant action is DISMISSED without prejudice. The Clerk shall terminate all
pending motions, enter judgment, and close the file.
