In support, the Trustee states: 1. On December 18, 2009, this Court entered its Order Denying the Trustee's Motion To Amend Findings and Judgment. The Trustee is currently evaluating whether to file an appeal of this Court's Orders of December 4 and 18, 2009. Absent extension under F.R.B.P. 8002(c), the Trustee's deadline for filing Notice of Appeal is December 28, 2009. Due to the intervening Christmas holidays and prior plans for the holidays of the Trustee's counsel, evaluation for determination of appeal will reasonably take an additional 10 days or until January 7, 2010.
