NOTICE OF FILING OF COMPLAINT AND ORDER APPOINTING RECEIVER
NOTICE IS HEREBY GIVEN that, on February 19, 2016, George E. Shoup, III (the
“Receiver”) was appointed as receiver over the assets of Boaz Shopping Center LLC, Eden
Shopping Center, LLC, Mayodan Shopping Center, LLC, Newton Shopping Center, LLC,
Plainview II Shopping Center, LLC, and Pueblo West Shopping Center, LLC, in the action
pending in the United States District Court for the Western District of Tennessee as ECP
Commercial I LLC v. Boaz Shopping Center, LLC, et al., Case No. 15-cv-02247-STA-cgc (the
“Foreclosure Case”).
Pursuant to 28 U.S.C. § 754, (i) attached herewith as Exhibit 1 is a copy of the Second
Amended Complaint that ECP Commercial I LLC filed in the Foreclosure Case and (ii) attached
herewith as Exhibit 2 is a certified copy of the Agreed Order Appointing Receiver, by which the
United States District Court for the Western District of Tennessee appointed the Receiver as

receiver of the Receivership Estate, as defined therein. This Notice is filed with the consent of the
Receiver.
