JOINT MOTION FOR ORDER APPROVING STIPULATION TO BIFURCATE The Plaintiffs and the Defendant hereby move jointly for an Order of the Court approving the attached Stipulation and Proposed Order re Bifurcation in this matter. As counsel indicated during the telephonic status conference with the Court on April 20, 2010, the parties have reached an agreement to bifurcate the trial of this action. Pursuant to that agreement, the trial scheduled to start June 21, 2010 will be a bench trial of only the Plaintiffs' claim for permanent injunctive relief set forth in the first claim of the Amended Complaint. The basis for and terms of the parties' agreement are set forth in more detail in the attached Stipulation. WHEREFORE, the parties request that this motion be granted.
