Dear Judge Stark:
We were surprised to see Mr. Rovner’s ex parte communication with the Court since he did not
confer with us before sending it. However, we also would like to take the opportunity to thank
you for taking the case, and echo our willingness to help your Honor, however, we can. For the
convenience of the Court we have attached a list indicating the 32 currently pending motions that
must be resolved before any trial can commence in this case. Your Honor will note that some
are potentially case dispositive, and that the summary judgment motions are currently being
briefed pursuant to the procedure in Judge Farnan’s standing order regarding summary judgment
motions in patent cases. If the Court wishes to have courtesy copies of any of these motions,
please do not hesitate to ask, we would be happy to deliver them.
