Stark United States District Court for the District of Delaware 844 North King Street Wilmington, DE 19801 Re: Dear Judge Stark: On behalf of both parties, enclosed please find a Stipulated Amended Scheduling Order for the Court's consideration. Pursuant to Your Honor's direction during the telephonic hearing held on September 8, the parties have agreed to amend certain dates in the Scheduling Order (D.I. 32) related to claim construction and discovery. In paragraph seven of the stipulation, the parties propose that the Court schedule a Markman hearing for a date in January 2011. Because counsel for Google are scheduled to be in trial and in pre-trial preparations and conferences in another case during the last two weeks of January, however, the parties respectfully request a hearing date during the first two weeks of January. In addition, although the parties have left the number of trial days blank, they jointly request that the Court set this case for a ten-day trial. Respect fully, Personalized User Model, L.L.P. v.
