BUSH, et al., : : Respondents. : : x [PROPOSED] ORDER GRANTING CROSS-MOTION TO STRIKE AND TRANSFER For the reasons set forth in the petitioner's cross-motion to strike the declaration of CIA Director Michael V. Hayden, and to transfer this case back to Judge Kennedy for all further proceedings, the motion is hereby GRANTED, and it is FURTHER ORDERED that: 1. The Court hereby strikes the declaration of CIA Director Michael V. Hayden, submitted in camera and ex parte (misc. dkt. no. 1005), from the record of these proceedings, and shall not consider it in connection with the government's pending motion for reconsideration of the Court's November 6, 2008 case management order entered in the Guantánamo Bay detainee cases; and The Court hereby transfers this case back to Judge Kennedy for all further proceedings.
