No. 08-442 (TFH) Civil Action No. 05-2386 (RBW) DECLARATION OF DANIEL G. SCHULOF CONCERNING AUTHORIZATION TO REPRESENT PETITIONER ALI SHER HAMIDULLAH (ISN 455) 1. My name is Daniel G. Schulof. I am over the age of 21, am competent to provide testimony, and have personal knowledge of the facts set forth in this Declaration. 2. I am an attorney licensed to practice law and in good standing in the state of Georgia. I am an associate with the law firm of Kilpatrick Stockton LLP. My home address is 860 Peachtree Street NE, Apt. # 1614, Atlanta, Georgia 30308. 3. Kilpatrick Stockton LLP is counsel of record for Mr. Ali Sher Hamidullah (ISN 455). Mr. Hamidullah is one of three foreign nationals detained at Guantanamo represented by Kilpatrick Stockton LLP. 4. This Declaration is made in response to the Court's Order of July 29, 2008 (Misc. No. 08-442, Doc. 210) directing counsel to file "a signed authorization from petitioner to pursue the action or a declaration by counsel that states that the petitioner directly authorized counsel to pursue the action and explains why counsel was unable to secure a signed authorization." 5. In January of 2007, Kilpatrick Stockton LLP was asked to provide pro bono legal representation to Mr. Hamidullah and the firm agreed. Since that time, our attorneys have exchanged numerous letters with Mr. Hamidullah and have visited him twice. 6. Along with two of my colleagues from Kilpatrick Stockton LLP, James F. Bogan, III, and John R. Gibson, I was at Guantanamo visiting with clients from October 6­8, 2008. We visited with Mr. Hamidullah on October 7, 2008. During our visit, Mr. Hamidullah verbally authorized Kilpatrick Stockton LLP to represent him, both in connection with the present litigation and in connection with any efforts to find a place for him to live outside of Guantanamo. 7. We have asked Mr. Hamidullah to provide us with a signed authorization. He has not provided us with the signed authorization and has not explained why. All I can say at this point without revealing too many details of our privileged conversations is that Mr. Hamidullah remains reluctant at this point to provide us with the signed authorization.
