NOTICE OF FILING
PLEASE TAKE NOTICE that having conferred with counsel for plaintiff, the
undersigned counsel hereby submits for filing on the public record redacted versions of
Defendants Holder and Mueller’s Motion to Dismiss and for Summary Judgment,
Statement of Material Facts, and Declaration of Joel D. Dabisch (collectively, “motion
papers”), which were filed under seal with this Court on June 16, 2011. Defendants
Holder and Mueller (“official capacity defendants”) do not concede that any of the
redacted information or any other information contained in the motion papers is subject
to the Privacy Act, and further maintain that public disclosure would be authorized by a
routine use under the Act. However, pending further review of this issue by the Court,
plaintiff and official capacity defendants have agreed to redact certain information from
the public versions of the motion papers, attached hereto, in order to protect plaintiff’s
personal privacy.
