Alexander, Director of the National Security Agency (NSA), insofar as they are sued in their official capacities, together with defendants NSA and the United States Department of Justice (collectively, the “Government Defendants”), for a stay of the Government Defendants’ deadline to respond to Plaintiffs’ Class Action Amended Complaint (Dkt. No. 4) (the “Complaint”), in light of the recent lapse in Government appropriations. The Court having considered the Government Defendants’ submissions in support of their motion and any submissions in opposition thereto, IT IS HEREBY ORDERED THAT: 1. The Government Defendants’ motion is hereby GRANTED. 2. The Government Defendants’ deadline to respond to the Complaint is STAYED until Congress has restored appropriations to the Department of Justice. Counsel for the Government Defendants will notify the Court as soon as Congress has appropriated funds for the Department of Justice. At that point, the Government Defendants’ deadline to respond to the Complaint shall be extended commensurate with the duration of the lapse in appropriations.
