Burton Wiand, as Receiver, hereby provides notice of filing the attached
Government’s Application for an Order Vacating the Preliminary Order of Forfeiture
(“Government’s Application”), filed by the United States Attorney for the Southern District
of New York on February 29, 2012, in United States v. Arthur Nadel, Case No. 1:09-cr00433-JGK (S.D.N.Y.) (Doc. 95). The Government’s Application relates to the dispute
regarding this Court’s jurisdiction over certain Receivership assets purportedly subject to

forfeiture in the United States District Court for the Southern District of New York. See
Docs. 690, 712, 733, 745, 753, 757.
