United States Attorney, hereby notifies the Court that on February 29, 2012, in
United States v. Arthur Nadel, Case No. 1:09-cr-00433-JGK, the United States
Attorney for the Southern District of New York moved to vacate the Preliminary
Order of Forfeiture dated October 21, 2010. A copy of that motion is attached
hereto.

Notice of the filing is being provided because it directly relates to the
jurisdictional issue raised by this Court, which is among the matters to be heard
at the hearing scheduled for March 2, 2012.
