Tunis Gerstein Justice Building Miami, Florida Via Fax URGENT Re: Bar v. Thompson Dear Referee Tunis: Attached is a subpoena for the deposition of Strauss Zelnick. Please issue it, as you have no option not to do so, per Florida Rules of Civil Procedure. This bizarre propensity you have had of refusing to issue subpoenas is illegal, as such issuance is a pure ministerial function, according to Florida law, which must be discharged upon even the "oral request of a party or attorney." Ms. Tuma, for her part, utterly refused to give me dates for discovery depositions, so she can't use that odd argument that I have to clear dates with her and the deponents before I get a subpoena issued. There's no Rule that supports that obstructionism, either, but she didn't comply with her own rules of obstruction. Recent events have made the taking of the deposition of this guy mandatory. Zelnick met with me months ago and promised that Take-Two would wage a "war' against me in retaliation for my efforts against his company's distribution of Mature-rated video games to minors. He also promised that he would thoroughly look into what Blank Rome had done. I want to inquire as to what he found, now we have the testimony of Judge Moore that proves the entire Blank Rome assault upon me was based upon fraud. Also, The Bar came up with a new Blank Rome complaint after Zelnick took over the company. Zelnick was behind that, of course. I need to ask about that, since The Bar used that to jack the suspension up from 90 to 91 days.
