TO MOTION TO COMPEL PRODUCTION OF DOCUMENTS AND TESTIMONY
REGARDING SET-TOP BOX COMPONENTS
Plaintiff/Counter-Claim Defendants Motorola, Inc. and Motorola Mobility, Inc
(collectively “Motorola”) file this notice of filing the Declaration of Attorney for Motorola, John
Duchemin, in support of Motorola’s Opposition (DE 291) to Apple, Inc.’s (“Apple”) Motion to
Compel Production of Documents and Testimony Regarding Set-Top Box Components (“MTC”)
and states as follows:

1.

On March 26, 2012, Apple filed its MTC under seal seeking the production of

documents and testimony relation to Motorola’s set-top box components.
2.

On April 2, 2012, Motorola filed a public-redacted version of its Opposition to the

MTC and emailed the unredacted version to Apple’s counsel.
3.

The Opposition references the attached Declaration by John Duchemin for

support, but the Declaration was mistakenly omitted from the public filing. Further, because the
unredacted version sent to Apple’s counsel included Mr. Duchemin’s declaration, no prejudice
results from the filing of the declaration.
Accordingly, Motorola files this notice of filing the Declaration of John Duchemin in
support of Motorola’s Opposition to Apple’s Motion to Compel Production of Documents and
Testimony Regarding Set-Top Box Components.
