JOINT NOTICE OF FILING OF PROPOSED ORDER SETTING MEDIATION
PLAINTIFF, MOTOROLA MOBILITY, INC., COUNTERCLAIM DEFENDANTS,
MOTOROLA, INC. and MOTOROLA MOBILITY, INC. (collectively referred to as “Plaintiff”)
and DEFENDANT and COUNTERCLAIM PLAINTIFF, APPLE, INC. (“Defendant”) (Plaintiff
and Defendant are jointly the “Parties”), in accordance with the Court’s Order of February 2,
2011 [DE46], hereby respectfully provide the attached proposed Order Scheduling Mediation. A
copy of the proposed Order is attached as Exhibit “A.” As the proposed Order provides, the
Parties have agreed that Anthony Piazza, Esq., shall serve as the mediator in this action and have
agreed to conduct mediation beginning at 9:30 a.m., on July 14, 2011 at the offices of Gregorio,

Haldeman, Piazza, Rotman & Frank, 201 Mission Street, Suite 1900, San Francisco, California
94105. A copy of the proposed Order will be also be sent to the Court via electronic mail.
