BRAVO: Good afternoon, Your Honor, Kenia Bravo and 6 7 8 9 Avelino Gonzalez for the plaintiff. MR. SANTINTI: Good afternoon, Your Honor, Sean Santini and Averil Andrews on behalf of the defendants. THE COURT: Good afternoon, everyone. All right. 10 Where are we in this case? I know there is a pending motion for 11 Rule 37 sanctions because Mr. Daudinot's deposition has not 12 been scheduled. 13 I know you have exchanged e-mails and responses. 14 I know, Ms. Bravo, your December is now free; and your 15 November, relative to the case as posing a scheduling conflict. 16 So, how are we going to proceed? 17 MS. BRAVO: Your Honor, what isn't free, unfortunately, 18 19 is our client. He was re-arrested in Cuba, no charges. This is something the authorities do with people in 20 Mr. Daudinot's position. So, he has been re-arrested. He is 21 scheduled to be released with no charges. 22 He should have been released on Friday, and he wasn't. 23 So we're hoping this week he is going to be released and we can 24 go ahead and get the Visa for him to come to the United States 25 in order to proceed with the deposition. 3 1 2 THE COURT: Okay. So the plan is Mr. Daudinot receives a Visa, comes to the U.S. for his deposition. 3 How long is that going to take? 4 MS. BRAVO: Before mediation -- the date scheduled for 5 mediation is January 14th. We are hoping to have him for 6 deposition before that time. 7 THE COURT: 8 All right. Mr. Santini, you don't have to reiterate what is in your motion. 9 Any thoughts about the plan as it now stands that Mr. 10 Daudinot comes to the U.S. and has his deposition taken before 11 mediation? 12 MR. SANTINI: Yes, Your Honor. The Court has asked I 13 not rehash the motion, but I think there are a few things worth 14 pointing out. 15 THE COURT: All right. 16 MR. SANTINI: It would have been nice to have been -- 17 my client has expended money in this briefing -- it would have 18 been nice to have gotten word of any of this at some point in 19 the process. 20 I think that is only fair that at a minimum we walk 21 out of this courthouse with an order that requires a date 22 certain for his deposition. 23 Plaintiff's counsel has made some representations 24 regarding general timeframes. I think it's fair I be told 25 exactly when I will be able to depose her client.
