CONSENT MOTION FOR ENTRY OF ORDER EXTENDING THE DEADLINE FOR CONSOLIDATED PRETRIAL ORDER COMES NOW Defendant, with Plaintiff's consent, and hereby respectfully moves this Honorable Court for entry of a consent order extending the deadline for filing of the parties' consolidated pretrial order in the above-styled matter. The Court issued its ruling on the parties' respective motions for summary judgment on November 23, 2010, the day before the Thanksgiving holiday. Therefore, pursuant to LR 16.4, the deadline for filing of the parties' consolidated pretrial order is December 23, 2010. Given the intervening and upcoming

holidays, Defendant respectfully requests that the deadline for the pretrial order be extended for eleven days until January 3, 2011, and Plaintiff consents.
