Grasmeyer : It has been brought to our attention that your business, Real Estate Tools, Inc . , PropertyTracker . com Inc, and www . realestatetools . com have been using our federally registered trademark FLIPPER in assoc i ation with the marketing or sale of your real estate products and services , namely "Property Flipper" . It is possible that you were unaware of this conflict, so we believe that it is in our mutual interest to bring this matter to your attention . We have registered the mark FLIPPER'S with the United States Patent and Trademark Office . The mark is registered for "computer software for calculation and analysis of real estate cash flow" in International Class 009 . The mark is registered on the Principal Register under Reg . No . 3089816, and a copy of the registration certificate is included with this letter . Th e term Fl i p per's legally covers F li p, Fl ipIt, F li pper, Flipping an d a n y o ther d e ri va tion on the term Flipper's as it re lates t o rea l es ta te analysis so ft ware .
Registration of a mark on the fede ral Princi p al Register confers a number of procedural and substantive legal r i ghts . These rights include the right to sue infringers in federal court . In federal court, profits, damages and costs are r ecoverable and tre bl e damages and attorney's fees are available . I n addition, our registration on the Princi pal Register is prima facie evidence of the validity of the FLIPPER'S registered mark, of the registration of the mark, of our ownership of the FLIPPER'S mark, and of our exclusive right to use the FLIPPER'S mark .
Pursuant to Sect i on 32 of the Lanham Act (15 U . S .C .A. § 1 114) : "(1 ) Any person who shall , without t he consent of the registrant(a) use in commerce any reproductio n , counterfeit, copy, or colorable im i tation of a registered mark in connection with the sale, offer i ng for sale, dist r ibution, or advertising of any goods or services on or in connection wi t h whic h such use i s likely to cause confusion, or to cause mistake, or to deceive ; or (b) reproduce, counterfeit, copy or colorably imitate a registered mark and apply such reproduction, coun terfeit, copy or colorable imi tat i on to labels, signs, prints, packages, wrappers, receptacles or advert i sements i ntended to be used in commerce upon or in connection with the sale, offering fo r sale, distribution, or advertising of goods or services on o r in connection with which such use is likely to cause confus i on, or to cause mistake, or to deceive, shall be liable in a c i vil action by the registrant for the remedies hereinafter p rovided ."

Accordingly , we have the right to pursue in federal court any third party that uses a colorable imitation of the FLIPPER ' S mark in connection with the sale of good s or services under c i rcumstances likely to cause c onfusion , or to cause mistake, or to deceive . It is important that we exercise our right to protect our trademark . It serves as an i mportant and distinctive re p resentation of the origin of our products as well as the goodwill of our company . State and federal law suppo rts our position that confusingly s i milar trademarks may cause confusion among customers . T his confusion may cause substantia l harm to the trademark by facilitat ing the loss of its effectiveness in establishing a distinct association betwee n it, our products and services, and our company's goodwill . Due to these concerns, and because unauthorized use of our federally registered trademark amounts to an infringement of our trademark rights, we respectively request that you cease and desist in any further use of the term Flipper or any derivation of the term in association with the marketing, sale, distribution, or identification of your products or services . We are also requesting that you immediately notify any and all of your vendors that may be selling your products so that they may update their websites and product materials . An increasingly common type of trademark infringement occurs when third parties use trademarks-or confusingly similar derivations of trademarks as "keywords" or metatags in an effort to mis-direct search engine traffic to their own sites . This type of infringement is also actionable, and may constitute trademark infringement, false designation of origin, unfair competition and dilution under the Lanham Act, 15 USC 1051 and the Anti-Cybersquatting Protection Act, 15 USC 1125(d), Moreover, keyword/metatag infringement may also be actionable under state common law under theories of infringement, unfair competition, misappropriation and unjust enrichment . Because we owns a federal registration for FLIPPER'S for "computer software for calculation and analysis of real estate cash flow," third parties who use FLIPPER'S (or confusingly similar imitations of the FLIPPER'S registered mark) as keywords or metatags for Internet web pages featuring related software are infringing on our prior rights .
As such , the term trademark "flipper", or any confusingly similar to the trademark, needs to be removed from your website's metatags, file names, and folder names .
Please respond by letter indicating your intention to cease and desist the use of the registered trademark Flipper, or any confusingly similar term to the trademark, within ten (10) calendar days . We have also contacted your Internet host provider about this infringement,
We hope that this issue may be resolved this way so we can avoid any further legal remed i es as provided by state law and the U .S . Trademark Act . In the event we elect to pursue a claim for trademark infringement against you and your company , we will file a claim for profits, damages and costs , including treble damages for willful infringement occurring after March 25, 2005 (the filing date of the trademark registration application), a s well as attorney's fees .
