Counsel for amicus curiae
I am an attorney admitted to the Bar of the State of Hawaii and to the Bar of
this Court. I am the attorney for the amicus curiae, the American Center for Law &
Justice (ACLJ), in the above-referenced action. The content of this declaration is
based on my personal knowledge.
1. On March 9, 2017, I sent by electronic mail a letter to Neal Katyal,
counsel for Plaintiffs, and to Brad Rosenberg, counsel for Defendants, in the
above-styled action. In my letter, I requested whether the parties objected to the
granting of the ACLJ’s motion for leave to file an amicus curiae brief in support of
Defendants’ opposition to Plaintiffs’ motion for a temporary restraining order.
2. On March 9, 2017, Mr. Katyal responded and informed me that Plaintiffs
consent to the granting of the motion. On March 10, 2017, Mr. Rosenberg
responded and informed me that Defendants take no position on the motion.
I declare under the penalty of perjury that the foregoing statements are true
and correct to the best of my knowledge.
Dated: March 13, 2017.
Respectfully submitted,
/s/ Robert K. Matsumoto
