MOTION TO WITHDRAW AS COUNSEL OF RECORD Daniel Purcell, of Keker & Van Nest, LLP, hereby moves to withdraw his appearance as one of the counsel of record for defendant, Google Inc., pursuant to Local Rule 83.17. In support of this motion, Mr. Purcell states as follows: 1. On May 29, 2008, this Court granted leave to Daniel Purcell of the law firm of

Keker & Van Nest, LLP to appear Pro Hac Vice on behalf of Google Inc. This Court had previously granted leave for Michael Page, Ragesh Tangri and Joseph Gratz, also of the law firm Keker & Van Nest, LLP, to appear Pro Hac Vice on behalf of Google Inc. Attorneys Joseph Duffy, Jonathan Cyrluk, Mariah Moran and Henry Baskerville of Stetler & Duffy, Ltd. have each filed their appearances in this case to serve as local counsel on behalf of Google Inc. 2. Recently, Messrs. Page, Tangri and Gratz left the law firm of Keker & Van Nest,

LLP to join the law firm of Durie Tangri Lemley Roberts & Kent, LLP. Google Inc. has

retained Durie Tangri Lemley Roberts & Kent, LLP to represent it in this matter and as such, Messrs. Page, Tangri and Gratz will continue their representation of Google Inc. 3. The law firm of Keker & Van Nest is no longer engaged to represent Google Inc.

in this case. Therefore, Mr. Purcell moves to withdraw his appearance that was filed on behalf of Google Inc. 4. Google Inc. has no objection to Mr. Purcell's request to withdrawal and will

continue to be represented by Messrs. Page, Tangri and Gratz. A copy of Notice of Change of Address for Messrs. Page, Tangri and Gratz are attached hereto collectively as Exhibit A. Furthermore, Stetler & Duffy, Ltd. will continue to represent Google Inc. in this matter as local counsel. WHEREFORE, based on the foregoing, Daniel Purcell respectfully requests the Court to grant him leave to withdraw his appearance of record in this matter.
