CONSENT JUDGMENT AND ORDER
Upon agreement of the parties, Plaintiffs United Food and Commercial Workers
International Union-Industry Pension Fund and its Trustees (" Plaintiffs") and Defendants Perkins
Management Services Company, Inc., Perkins Management Services Operations, LLC, Perkins
Restaurant Development Company, LLC, N.M. Perkins Enterprises, Inc., Bolt Waste
Management Services Company, Perkins Goum1et Food Products, Inc., Perkins Agricultural
Corporation, Perkins Burger Ventures, LLC, PMSC Holdings, and Titan Food and Nutrition
Services Company ("Defendants") hereby stipulate to entry of judgment in favor of Plaintiffs
and against Defendants, jointly and severally, as set forth herein:
WHEREFORE, judgment is hereby entered in favor of Plaintiffs and against Defendants,
jointly and severally; and it is
FURTHER ORDERED, that Plaintiffs are awarded and Defendants shall pay to Plaintiffs
a judgment in the total amount of $118,914.11 , which is comprised of $94,100.00 in withdrawal
liability, $261.61 in interest, $18,820.00 in liquidated damages, and $5,732.50 in attorneys' fees
and costs; and it is
FURTHER ORDERED, that thi s Consent Judgment and Order is subject to execution in
any court of competent jurisdiction, and any and all terms of this Consent Judgment and Order
may be enforced by Plaintiffs in any court of competent jurisdiction; and it is
FURTHER ORDERED, that should any Defendant fail to comply with any terms of this
Consent Judgment and Order, Plaintiffs may, in addition to pursuing remedies provided under
Fed. R. Civ. P. 69, reopen this case upon motion to this Court and notice to the Defendants, and
may at that time ask for further appropriate and/or injunctive relief.
