Cross-Motion having been made by Defendant for Summary Judgment that it does not infringe, or induce others to infringe, the `839 Patent. The Court, having reviewed and considered the parties' respective memoranda and supporting material, and any responses thereto, and the entire Record in this cause, and otherwise being duly and sufficiently advised, IT IS HEREBY ORDERED AND ADJUDGED that Plaintiff's Motion for Preliminary Injunction is DENIED. IT IS FURTHER ORDERED AND ADJUDGED that Defendant's Motion for Summary Judgment of non-infringement of the `839 patent by Google Notebook is GRANTED.
