("Apple"), requests an expedited hearing in this matter because oral argument on multiple Motions to Dismiss filed by Apple is set for Thursday, October 28, 2010 at 9:30 a.m. Furthermore, under the present briefing schedule applicable to all of the pending motions, the Plaintiffs are required to file their responses on or before October 1, 2010. Because the current briefing deadline is set for October 1, 2010, an expedited hearing of this matter is warranted so that this Court may have sufficient time to consider Apple's Motion To Continue and Re-Set Briefing Schedule On Apple Inc.'s Preliminary Motions.
