AT&T Mobility LLC (“ATTM”) respectfully submits this notice of recent decision to
inform the Court of the decision in Kaltwasser v. AT&T Mobility LLC, No. 07-cv-00411 (N.D.
Cal. Sept. 20, 2011), enforcing ATTM’s arbitration agreement under Concepcion, in advance of
the status conference scheduled for September 22, 2001. A copy of the decision, which was
issued after ATTM filed its position paper on September 19, 2011, is attached as Exhibit A.
