Fred Phelps, Sr. and Westborough Baptist Church Dear Mr. Katz: Pursuant to your request, please be advised that I am willing to undertake a forensic psychiatric evaluation in reference to the above-noted case provided that certain conditions are fulfilled. A forensic psychiatric evaluation involves considerable preparation. It is my practice, depending on the case, not only to review all the materials specifically gathered with regard to the particular case, but also to study relevant literature. It is important that all relevant medical reports, depositions, investigation reports, etc. be sent to me prior to conducting my forensic psychiatric examination. Forensic psychiatric services are rendered on the condition that the attorney assume full responsibility for payment of any and all services in connection with the case. My fee is $400.00 per hour for time for review of documents and relevant medical literature, client, witness and attorney interviews and report preparation. Testimony, either in court or by deposition, and travel time are billed at $500.00 per hour. Out-of-pocket expenses for items including, but not limited to, mileage, parking, long distance telephone calls, messengers, extraordinary postage, computer search charges and copying, are billed in addition to the hourly rate. Appointments or court dates not canceled by you 72 hours in advance will be billed for the time reserved by me. Prepayment of $5,000.00 will be required before I can begin work on this case. This retainer is non-refundable. My time and expenses will be billed against this retainer. I agree not to exceed the retainer amount without your prior approval. For any approved additional charges, payment is expected upon receipt of such bills. Bills not paid in full within thirty (30) days of date of invoice will be charged 1½% per month. If any fee is placed in the hands of an attorney for collection or is collected through any legal proceedings, the undersigned agrees to pay the fees incurred to the extent permitted by law.
