Pursuant to the Court’s September 30, 2009, Memorandum and Order requiring the
parties “to notify this Court with a status report within 10 days of any material developments
concerning the continued vitality of the Northern District of California Judgment,” Dkt. No. 274,
notice is hereby given that on April 11, 2011, the Ninth Circuit Court of Appeals issued an
Opinion affirming the June 23, 2008, holding by the Northern District of California enforcing the
parties’ Settlement Agreement.
A copy of the Ninth Circuit Opinon is attached hereto as Exhibit A.
