Thank you for your email. As you may recall, Judge Wolf’s order on the Motion to Dismiss noted that he would be
setting a schedule for this matter (p. 26 of his decision), but he has yet to do so. Due to this procedural uncertainty, I
had delayed filing our Answers, but thought that it might be worthwhile to do so.
I would kindly ask to you refrain from filing your motion to strike as it is obvious that this case will proceed through
discovery and summary judgment, and possibly beyond. That said, I completely understand your position.
