Hall; Cathy Dittrich Re: Issues with New Trial Date Will: As of yesterday, Lily, Dennis, and Misino were not committed to come to the prior trial date despite my effort for months to receive commitments. Also as of Tuesday's hearing you were not planning on brining your co-counsel to trial Carlos Singer. The suggestion that all these folks became important in the last 24 hours in puzzling. The only person whose situation apparently has changed is Korf. We would request a detailed affidavit of his alleged conflicts. A pretty full schedule suggests that he can get away for one day the second week. Assuming we agree with the assertion that there is a problem after reviewing his affidavit, we have no problem agreeing to put him on the stand during our case if necessary. We have no problem agreeing to take his trial testimony by deposition if necessary. I doubt the court will believe that he can not make one in 14 days of trial. FYI: Brian and I are out most of May in two conferences, one of which we are sponsoring. We believe that Defendants have every incentive to delay and will make vigorous arguments to that effect. Enrico Schaefer www.TraverseLegal.com enrico.schaefer@traverselegal.com 866.936.7447 On Feb 29, 2012, at 11:25 PM, William Delgado wrote: Enrico,     I am emailing to apprise you of some scheduling issues that I am having with the new trial date.  I am still in the process  of contacting witnesses (as I was earlier in the week) but now face an additional difficulty: some of those persons who  had committed to the earlier trial date may not be available during the two weeks of the new trial date.  Specifically, my  co‐counsel, Carlos Singer, is scheduled to be in Philadelphia for several days the first week of trial; Rich Korf had planned  to be on vacation the week of March 26th (UCLA spring break) and has a pretty full schedule the following week (first  week of second quarter); Dennis Rhee, definitively cannot come during the new trial date because it conflicts with a  work project he has due around the same time.  I have not yet been able to verify whether the change affects the  availability/willingness of Donnie Misino or Mavi Llamas.  I am also awaiting confirmation from John Berryhill.     1 I am trying to work through these issues to see what I can do but, at best, I already know that Dennis cannot make it,  and Carlos will be gone for part for the time.  As a result, I may have no choice but to ask the Court to continue the trial  date into the future.  I know she said she was gone for a few weeks in April but perhaps she has time in late May‐early  June.  (I can’t do early May; David Graff is having surgery on May 1 and is getting a “no travel” ban for 3 weeks as a  result.)     Obviously, I am writing to see if this is something we can address jointly and then present to the Court.  I suspect not but  given that additional time may be helpful in sorting out the situation with Seth Jacoby and, perhaps, in helping your  clients prepare for their IRS audit, perhaps I am wrong about that.  Let me know.     Thanks,  Will  2
