Certain offenders were assigned a risk level in a manner found to be unconstitutional by a federal court (see the additional information about Doe v. Pataki located in Legal Information.) Therefore, it is possible that the number of level 2 or level 3 sex offenders listed in a county may include certain offenders who have not yet been afforded a constitutionally sufficient hearing to determine the risk level and are not listed in the Subdirectory.
