DECLARATION OF DAVID H. MCGILL
I, David H. McGill, Esq., make this declaration pursuant to 28 U.S.C. § 1746 and state as
follows:

I am an attorney duly admitted in the State of New York, a member of the bar of
this Court, and an associate with the law firm of Kobre & Kim LLP, counsel for GlobeOp
Financial Services LLC (“GlobeOp”) in the above-captioned action. I respectfully submit this
declaration in support of GlobeOp’s Statement Regarding Plaintiffs’ Motion for Final Approval
of the Proposed GlobeOp Settlement and Plan of Allocation and an Award of Attorneys’ Fees
and Reimbursement of Expenses.

Attached as Exhibit A is a true and correct copy of the letter (without enclosures)
providing notice of the proposed partial settlement of the above-captioned action sent to the
appropriate State and Federal officials on September 24, 2013 pursuant to 28 U.S.C. § 1715. At
the request of Plaintiffs’ counsel and to protect the privacy of the claimants referenced in the
September 24, 2013 letter, the names of the investors have been redacted from Exhibit A.
GlobeOp will provide the actual names of the investors if requested by the Court.

Pursuant to the Stipulation of Settlement (the “Stipulation”), on September 23,
2013, the GlobeOp Settlement Amount of $5,000,000 was transferred to the Account (as defined
in the Stipulation), which is under control of the Escrow Agent (as defined in the Stipulation).
I declare under penalty of perjury that the foregoing is true and correct.
