Morning Mist plaitis' motion (i) to vacate the Cour's Order dated June 9, 2009 (Dkt. 167,09
CV 0118, and Dkt. 11,09 CV 5012), which consolidated for pretral puroses Morning Mist

with

the Anwar action, 09 CV 0118 (V; and (ii) to appoint movants' counel, Milberg LLP and
Seeger Weiss LLP, as Co-Lead Dervative Counsel.
