This matter having come before the Court on motion of the Plaintiff, Commonwealth of
Kentucky ex reI. J. Michael B.rown, Secretary of the Justice and Public Safety Cabinet, for an
order pl.rsuant to KRS 528.100 for seizure and torJeiture of internet domain names used to

promote, conduct andlor advance illega l gambling within the Commonwealth of Kentucky; the
Commonwealth having presented evidence and argument; and the Court being sufficiently
advised;
IT IS HEREBY ORDERED AND ADnIDGED as follows :
1.

Probable cause did and does ex.ist under KRS 528.100 to believe that the Domain

names listed as Domain Defendants on Ex.hibit A attached hereto were and are beiug llsed in
connection with illegal gambling activity within the Commonwealth of Kentucky in violation of
KRS Chapter 528.
2.

A sufficient basis did and does exist for the seizure and foIieiture of the Domain

Defendants by the Commonwealth.

3.

The Domain Defendants are properly seized by the Commonwealth of Kentucky

pursuant to KRS 528.100.

4.

The domainllames shall be immediately transferred by their respective Registrars

to an account of the Plainliff, Commonwealth of Kentucky, al each Registrar or, if Plaintiff so
specified, to such other Registrar as Plaintiff may designate. The domain names' configurations
shall otherwise remain unchanged. The domain names shall not subsequently be transferred,
moved, cancelled or otherwise affected except by instruction of the Plaintiff or this Court
pursuant to KRS 528.100 and/or KRS 500.090.

5.

The CorrulJonwealth shall electronically serve this Order upon each Registra.r via

thc procedures set forth in each Registrar's written policies and the written policies of ICANN
and by overnight courier.

6.

Seizure of the properiy il1 rem constitutes notice to any persons who may claim an

interest, pursuant to KRS 500.090, in the seized property.

The Commonwealth shall

neveriheless also use reasonable dforts to give notice by overnight courier, email Or facsimile to
the party identified by the WHOTS information as claiming ownership of each domain name.

7.

On September _ _ __ , 2008, at _ _ __ em., this Court shall conduct a

hearing to determine if any party has asser1ed rights as an owner of the seized property pursuant
to KRS 500.090, and whether said party qualifies for return of the property pursuant to that
statute, failing which the property shall be disposed of by tlte Commonwealth pursuant to KRS
500.090.
